Bad faith in trademark law refers to the act of intentionally filing a trademark application or using a trademark that infringes on the rights of another party. This can include using a trademark that is confusingly similar to an existing trademark, filing a trademark application with false or misleading information, or attempting to register a trademark with the intent to profit from the reputation or goodwill of an existing trademark.
